DOJ Guidelines on Hhi ranges for evaluating mergers
- any merger that leaves an industry with a HHI below 1,000 will not be challenged
- when the HHI falls between 1,000 and 1,800, the proposed merger will be carefully scrutinized to determine its competitive impact
- when the postmerger HHI will be above 1,800, it will almost always be challenged
